By accessing or using the SoulDot platform, website, and associated services (collectively, the "Service"), you ("User") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms constitute a legally binding agreement between you and SoulDot ("Company," "we," "us," or "our"). If you do not agree to these Terms in their entirety, you must immediately cease using the Service.

We reserve the right to amend these Terms at any time. Continued use of the Service following notification of amendments constitutes acceptance of the revised Terms.

SoulDot provides AI-powered emotional support conversations facilitated by artificial intelligence systems ("AI Counselors"). You expressly acknowledge and agree that:

• The AI Counselors are not licensed therapists, psychologists, psychiatrists, doctors, counsellors, or any other regulated healthcare professionals;
• The Service does not constitute the provision of psychological, psychiatric, psychotherapeutic, or medical advice, diagnosis, or treatment;
• The Service is not a substitute for professional mental health care, medical treatment, or crisis intervention;
• The Service is not a crisis helpline and cannot guarantee real-time human intervention in emergency situations;
• AI Counselors may make errors, provide inaccurate information, or fail to detect crisis signals. You must not rely solely on the Service for decisions regarding your mental or physical health;
• Any information, suggestions, coping strategies, or responses provided by the Service are for informational and emotional support purposes only and do not constitute professional advice.

SoulDot shall bear no liability whatsoever arising from any failure to provide emergency services or timely crisis intervention.

You must be at least 18 years of age to use the Service. By registering, you represent and warrant that you are 18 or older. If we discover or have reason to believe that a User is under 18, we will immediately terminate that account and delete associated data. The Service is intended for users resident in Malaysia, though it may be accessed internationally at the User's own risk and in compliance with local laws.

You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are solely responsible for safeguarding your login credentials. You must notify us immediately of any unauthorised access to your account. SoulDot is not liable for any loss or damage arising from your failure to maintain account security.

SoulDot offers a limited free trial period upon registration. Following the trial, continued access to the Service requires an active paid subscription. By subscribing, you authorise us to charge your designated payment method for recurring subscription fees at the applicable rate. Subscriptions automatically renew unless cancelled prior to the renewal date. All fees are non-refundable except as required by applicable Malaysian consumer law. We reserve the right to modify pricing upon reasonable notice.

You agree not to:

• Use the Service to impersonate any person or entity, or to access another user's account;
• Attempt to reverse-engineer, probe, or exploit the AI systems or platform infrastructure;
• Submit false, misleading, or harmful content to the AI Counselors;
• Use the Service for any unlawful purpose or in violation of any applicable Malaysian or international law;
• Attempt to extract confidential information about other users or the system through the AI Counselors;
• Attempt to override, circumvent, or manipulate safety protocols or AI instructions through prompt injection or similar techniques;
• Share your account credentials or permit third parties to use your account.

All content, software, trademarks, and materials on the Service are owned by or licensed to SoulDot. You are granted a limited, non-exclusive, non-transferable, revocable licence to access the Service for personal, non-commercial use. No rights in the Service are transferred to you beyond this limited licence. Conversation outputs generated by the AI Counselors are provided solely for your personal use and may not be reproduced, distributed, or commercialised.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY MALAYSIAN LAW, SOULDOT DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT PROVIDED BY THE AI COUNSELORS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOULDOT, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, LICENSORS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES;
• LOSS OF PROFIT, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY;
• PERSONAL INJURY, PSYCHOLOGICAL HARM, OR HEALTH OUTCOMES ARISING FROM RELIANCE ON THE SERVICE;
• FAILURE OF THE SERVICE TO DETECT OR APPROPRIATELY RESPOND TO A CRISIS OR EMERGENCY SITUATION.

WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO SOULDOT IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR $100.00, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless SoulDot and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content or information you submit to the Service.

We reserve the right to suspend or terminate your account and access to the Service at any time, without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties. Upon termination, your licence to use the Service immediately ceases. You may request deletion of your account and associated data by contacting us at the address below.

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these Terms, including any question regarding existence, validity, or termination, shall be submitted to the exclusive jurisdiction of the High Court of Malaya at Kuala Lumpur. Nothing in this clause limits SoulDot's right to seek injunctive relief in any court of competent jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
